Hip-hop mogul Jay-Z is one step closer to getting his day in court against Houston attorney Tony Buzbee after a judge signaled that his defamation of character lawsuit will move forward.

Last week, Jay-Z confirmed he was proceeding with legal action against Buzbee, who named him in a lawsuit against Bad Boy Entertainment CEO Sean “Diddy” Combs. The lawsuit alleged that Jay-Z and Diddy were involved in the rape of a minor 20 years ago—a claim that was later dismissed. According to Rolling Stone, a Los Angeles judge, Mark H. Epstein, stated on Tuesday that Jay-Z’s defamation claim has enough merit to move forward. The judge noted that the key issue is whether Buzbee acted recklessly and with actual malice when he included Jay-Z as a defendant in the now-dismissed lawsuit.

While Jay-Z’s defamation claim will proceed, the judge signaled he was inclined to dismiss the rapper’s related extortion claim against Buzbee. However, after a two-hour hearing, Judge Epstein withheld a final ruling, stating he needed more time to review the oral arguments presented by both sides.
